Our Practice Areas

The Types of Criminal Charges We Defend

We represent all levels of charges from traffic infractions to life and capital felonies. Among the most common charges we see at our criminal defense law firm are the following:

Many people underestimate the impact of traffic infractions and crimes. The penalties for traffic charges in Florida can have a big impact on your life.

  • Moving Infractions – This includes speeding, violation of a traffic control device, failure to use due care, and more.
  • Traffic Misdemeanors – These are criminal violations that can lead to jail time. These include reckless driving, driving with a suspended license, violation of license restrictions, etc.
  • DUI – This includes driving under the influence of alcohol or drugs. We represent individuals who are facing their first or second convictions or with multiple convictions.
  • Hit and Run – Leaving the scene of an accident is a criminal offense. We defend clients who have been charged with leaving a scene of a traffic crash.
  • Vehicular Manslaughter – If you’ve been charged in a crash that resulted in the death of another person, you could be sent to prison. Attorney Blecher can represent you in a vehicular manslaughter arrest.

Property crimes can be charged in conjunction with persons crimes, like robbery, or they may only involve theft or vandalism. These are some of the types of property crimes attorney Blecher defends:

  • Retail Theft – Also referred to as shoplifting, the level of charge you are facing depends on the dollar amount of the allegedly stolen items.
  • Burglary – This involves entering or remaining on the physical property of another with the intent to commit another crime. Burglary is frequently involved in theft, but it can also be a part of a persons crime.
  • Criminal Mischief – Damaging the property of another can be a misdemeanor or felony crime, depending on the amount of damage or the type of property.
  • Persons crimes usually involve physical harm to another. The types of persons crimes that attorney Blecher defends include:

    • Assault – This is a threat of imminent harm without a deadly weapon. Assault is a second-degree misdemeanor in Florida.
    • Battery – This involves touching or striking a person against their will. Battery is a first-degree misdemeanor crime.
    • Aggravated Assault – This is often referred to as an assault with a deadly weapon. It involves an imminent threat with a deadly weapon, like a knife or gun. Aggravated assault is a third-degree felony in Florida.
    • Aggravated Battery – Aggravated battery occurs when the defendant uses a weapon, causes serious bodily injury, or strikes a pregnant woman. This is a second-degree felony in Florida.
    • Stalking – This is a pattern of behavior meant to intimidate or harass the victim. Aggravated stalking includes either the threat of violence or simple stalking in violation of a restraining order.
    • Robbery – Robbery is both a property crime and a crime against a person. Robbery occurs when the suspect uses the threat or use of physical force to commit theft.
    • Homicide and Attempted Homicide – Attempting to or succeeding in taking the life of another is treated very seriously within the state. Depending on the circumstance of the incident, homicide can lead to life in prison or the death penalty.

Many different types of crimes can also qualify as domestic violence crimes. For example, battery is a domestic violence crime if the victim and offender have a domestic relationship. Domestic relationships include:

    • Spouses
    • Former Spouses
    • Persons related by blood or marriage
    • Persons who reside together as a family
    • Parents of a child in common, regardless of marital status

Domestic crimes carry additional penalties, including mandatory participation in a 26-week batterer’s prevention program.

This is by no means an exhaustive list of the types of crimes that our Jonathan Blecher defends. Call our office in Miami, FL if you’ve been charged with a crime that you don’t see listed here.

If you have a criminal record in Florida, it can destroy your future. Perhaps you made a mistake years ago or were in the wrong place at the wrong time. The charges may have been dropped later on or the case could have been dismissed, but it will stay on your record. Anyone will be able to access it and make judgments about you.

With a criminal record, you’ll have greater challenges ahead, making it harder to:

    • Get hired for a job
    • Find and be approved for rental housing
    • Take out a home or auto loan
    • Access federal aid for student loans

Cleaning up your record with a record expungement may be an option, depending on the facts of your previous criminal matter. With a record expungement, your record can be deleted in whole or part. This process ensures it will not show up in almost all background checks, making it easier for you to move forward with your life in a positive direction.

If you wish to expunge your criminal record, this lengthy process is something that attorney Jonathan Blecher can help you through. Call today to discuss your situation in complete confidentiality.

Once you are arrested, your mugshot will be accessible to anyone through a simple search on the internet. For many, one small error in the past can burden them for years to come through these arrest photos. You may be trying to start a new career, buy a home, or get approved for a rental property, and this unflattering portrayal of you can cast doubt upon your current character.

Mugshots online are particularly problematic because they can be posted even if you are not found guilty of a crime. It’s not fair since mugshots are taken at the time of arrest, and whether or not you are formally charged with a crime, they stay on the internet forever.

With the help of an attorney, you may also be able to have your record expunged or sealed if your case was dismissed for the following crimes:

    • Assault
    • Burglary
    • Domestic violence

Not all mugshot removal websites are regulated and often, many are unsuccessful in completely erasing this part of your past. With the help of Jonathan Blecher, you can remove this haunting relic from your record and start fresh again. Schedule a no-cost case review to discuss how you can have your mugshot permanently removed from the internet.

    Penalties for Florida Crimes

    • Second-Degree Misdemeanor – Up to 1 year in county jail and $1,000 in fines.
    • Third-Degree Felony – Up to 5 years in state prison and $5,000 in fines.
    • Second-Degree Felony – Up to 15 years in state prison and $10,000 in fines.

    • Life Felony – Up to life in prison and $15,000 in fines.
    • Capital Felony – Punishable by life in prison or the death penalty for first-degree murder.

Examples of additional penalties for certain crimes include minimum jail sentences, probation, loss of your driving privileges, mandatory courses, purchase of an ignition interlock device (for DUI cases), and inclusion in the sex offender registry.

    Building a Criminal Defense

In order to properly defend you against your charges, Miami criminal defense attorney Jonathan Blecher must examine all aspects of our case. This involves the following steps:

    • Reviewing all prosecutorial evidence of the incident – This includes the police reports, police supplements, the probable cause affidavit, 911 call recordings, radio dispatch recordings, witness statements, victim statements, photo lineups, physical evidence, body-cam footage, and more.
    • Subpoenaing and Deposing All Witnesses – A criminal defense lawyer has the right to ask questions to anyone who is involved in the prosecution of their client. For instance, the victim, witnesses, and arresting officers are all subject to subpoenas in criminal cases.
    • Retaining Expert Witnesses – In some criminal cases, attorney Blecher may believe it’s in his client's best interest to retain expert witnesses that can refute specific types of evidence against his client.
    • Filing Pretrial Motions – The police sometimes intentionally or unintentionally obtain evidence illegally. In these instances, attorney Blecher can bring the errors before the court. If the court agrees that the evidence was wrongfully obtained, it can’t be used in your prosecution. This can weaken or completely dismantle the prosecutorial case.

Once attorney Blecher is familiar with all aspects of the case, he can begin building your defense. These are some of the common criminal defense that our Miami criminal defense attorney has used successfully with other clients:

    • Illegal Stop – The police did not have legal justification to stop you.
    • Illegal Search – The police searched you, your car, or your property without consent, a warrant, or a valid warrantless exception.
    • Improper Showup – The police conducted a Terry stop improperly. This could be because they moved you from your original location, it was too far from the scene of the crime, they detained you for too long, etc.
    • Improper Lineup – The police failed to find similar subjects for the lineup, or the police told the witness who to pick.
    • Coerced Statement – The police questioned you in a way that violated your rights.
    • Mistaken Identity – The victim or witnesses were mistaken in identifying you.
    • Victim is Uncooperative – Victims often change their minds about prosecution. The court will often agree to drop the charges.

Why Hire a Miami Criminal Defense Attorney?

Many defendants opt for a public defender instead of a private Miami criminal defense attorney, like attorney Blecher. Here are several reasons why this is a bad idea:

    • Public defenders frequently have fewer than three years of criminal defense experience.
    • Public defenders are often shuffled to different departments and aren’t allowed to take their caseload with them. You could find yourself being represented by two or more attorneys, depending on how long your case lasts.
    • The Public Defender’s Office is understaffed and receives hundreds of new cases every week. Your attorney may not be given the resources necessary to develop a proper defense.

As an independent criminal defense lawyer, attorney Jonathan Blecher manages his own caseload. That means he can dedicate the resources to properly represent each client. Jonathan Blecher was admitted to the Florida Bar in 1982 and has four decades of relevant experience. He has an unparalleled track record defending clients just like you

Jonathan was able to reopen my case and he won.

“I don’t even know where to start i have been battling having a suspended license for about 10 years which led me to become an habitual driver I called around looking for lawyers and each and every one of them turned me down and said that my case was too old and that I will just have to wait out the 5 years. I am a single mother and I have been catching Uber Lyft and getting rides with friends to and from work spending so much money that I don’t have while trying to pay bills. It has really been a struggle for me. I am so blessed to have came across Jonathan. He is truly a blessing for taking his time with me and helping me. He was very professional, he responded quickly and always kept me updated. Jonathan was able to reopen my case. The same old case that other so called lawyers claim that was too old to open and he won. I couldn’t do nothing but cry. I’m so grateful for him. If he was able to help me he can help anybody. Thank you once again Jonathan!”
