Woman, 19, Faces DUI Manslaughter for Miami-Dade Crash

On Wednesday, Dec. 9, a young woman facing a DUI manslaughter charge for a deadly Miami-Dade crash that killed her passenger had her first court appearance.
S. Restrepo, 19, was charged in the September 2015 crash that took the life of her young passenger, L. Aguilera.
Aguilera’s mother told NBC 6 News that she not only blames Restrepo, but she blames the motel where the pair were partying before they left. It’s unclear if a civil suit was filed against the motel for negligence.
The victim’s mother said that Restrepo and her son went to a party on Northwest 60th Avenue where more than 20 young people were drinking and doing drugs in a motel room. She says that no one stopped them.
At some point, Restrepo and Aguilera left the party in her vehicle.
In an exclusive interview with NBC 6, the victim’s mother, A. Aguilera-Rivera, said that when you’ve had one or two drinks, don’t drive.
When the pair left the party at the motel, Aguilera, 20, was sitting in the passenger seat of Restrepo’s car, which she slammed into a tree after they left the party. The young man died in the hospital a few days after the accident.
After a three-month long investigation, Restrepo was arrested on Monday, Dec. 7.
Aguilera-Rivera said that to her, her son is still alive. She said that she forgives Restrepo, she really does, and she just hopes that God finds her son.
Restrepo’s arraignment was scheduled for Dec. 28, 2015.
Penalties for DUI Manslaughter in Florida
In Florida, DUI offenses are covered under Section 316.193 of the Florida Statutes. When while under the influence of alcohol or
drugs, a driver kills another human being or an unborn child, they commit the offense of DUI manslaughter, a felony of the second degree and punishable by:
- Up to 15 years in prison
- A maximum fine of $10,000
Note: Anyone who is convicted of DUI manslaughter will be sentenced to a mandatory 4-year term of imprisonment.
