Tips to Improve Your Florida DUI Case

Facing driving under the influence (DUI) charges for the first time in Miami? If so, it’s important to understand that there’s a lot at stake. What you do or don’t hear from this point forward can impact the outcome of your DUI case – and that can be a positive or a negative thing depending on what you do.

1. Stop drinking alcohol…for now. While DUI charges are pending against you, it’s best to avoid drinking alcohol, especially while in public. Even better, it’s wise to steer clear of licensed establishments that sell alcohol, such as bars and nightclubs. The last thing you need is a public intoxication charge while you have a DUI case pending in court.

2. Clean house. You may not have a drinking problem at all. Perhaps the DUI was a one-time slip in judgment, but even still, it’s wise to rid your house of alcohol just to be safe. Sometimes, people drink and even though they’re at home, they end up in a domestic dispute and before they know it, they’re facing assault charges.

While your DUI is pending, you want to avoid being arrested for a new offense. The same goes for DUI diversion and DUI probation. You do not want to be arrested for another offense while you’re under the thumb of the courts, whether it involves alcohol or not.

3. Contact a DUI attorney. You may have made a mistake, but that’s no reason to represent yourself and say “yes” to whatever the judge hands down. For first-time offenders, there can be options to traditional prosecution, such as the Back on Track Program, which avoids the stigma of a criminal conviction, but you need a lawyer to help you explore your options. Trust me, you don’t want to miss this once in a lifetime opportunity.

4. Consider the Back on Track Program. As a first-time DUI offender, you want to find out if you qualify for the Back on Track Program. To be eligible, you must meet the following criteria:

  • This has to be your first DUI arrest.
  • You did not hurt anybody else.
  • You did not cause an accident with another vehicle.
  • There were no minor children in your vehicle at the time of the arrest.
  • There were no open containers of alcohol in your vehicle.
