Can I Get a DUI on a Bird or Lime Scooter?

Motorized scooters are a new, efficient and quick method for travel all over the country. Can a driver get a DUI on one of them? In California, Los Angeles prosecutors convicted a person operating a motorized Bird scooter. In other states like Illinois, Colorado, and Indiana, residents would be at risk of a DUI arrest.
Under Florida DUI law, a person must be driving or in actual physical control of a vehicle while under the influence. The Florida DUI law defines “vehicle” as “every device …by which any person or property is or may be transported or drawn upon a highway, except devices using rails or tracks”. Though motorized scooters are not considered “motor vehicles” under Florida law, the use of Lime and Bird scooters would be considered a “vehicle”.
Florida courts have held bicycles to be vehicles. Bicyclists have the right to share the road with motorists. In addition, they must also follow the same laws as motorists too. Florida has convicted drivers of horses, lawnmowers, and golf carts as well.
