Day Drinking DUIs

By Jonathan Blecher on January 14, 2021

Drunk driving is treated as a serious offense in Florida and, in a state that offers such beautiful weather and a bevy of hot spots dedicated to getting the party started early, day drinking is often a problem. The penalties for a DUI conviction can be steep, even for a first-time offender, so it is crucial to hire an attorney to represent your case and aggressively advocate on your behalf.

DUIs in Florida

According to the Centers for Disease Control and Prevention (CDC), 2.1% of drivers in Florida reported driving after drinking too much alcohol, which is higher than the national average. Although the COVID-19 pandemic is affecting how Floridians used to party, there is no doubt that many of the most favored party spots, such as the Shaker Sunday at the Broken Shaker, Upstairs at No. 3 Social, and the Backyard Boogie at Wood Tavern, will be packed with day drinkers once it is safe to spend time in crowds again. Unfortunately, if these partygoers fail to use a ridesharing service or a designated sober driver, they may face a DUI on their way back home.

Below are some of the penalties you may face for a DUI in Florida:

  • First-time offense: A fine between $500 and $1,000, vehicle impoundment for 10 days, and a jail sentence of up to 6 months or probation up to a year. You may also have to serve 50 hours of mandatory community service and have your license revoked for a minimum of 6 months.
  • Second-time offense: A fine between $1,000 and $2,000, vehicle impoundment for 30 days, and a jail sentence of up 9 months. You may also have your license revoked for 6 months or 5 years if you were convicted within 5 years of your first offense.

For subsequent penalties, the penalties will be substantially more severe, and you may even have your license permanently revoked.
