Types Of Bail Bonds

There are many different kinds of bail bonds available, but there are two types that are more common than the others – a surety bond and a cash bond.

  • Surety bonds: When a person uses a bail bondsman who is responsible for their obligations and debts, this is known as a surety bond. In this situation, the bail bondsman would pay the full bail amount and, in return, the arrested person will pay the bail bondsman part of the assigned bail. In Florida, 10% of the assigned bail is a standard fee in State court, while 15% is common in federal court cases. Additionally, the bail bonding company will require that you provide them with collateral for the bond they post on your behalf. This collateral may come in the form of a promissory note or mortgage on real property.
  • Cash bond: When the arrested person uses cash to pay the full amount of the bail, this is known as a cash bond. Cash bonds are more effective in circumstances when a judge sets a low bail amount. For example, if you were arrested for a DUI, the bail may be set rather low, at around $500. In this situation, it would make more sense to pay it in cash. When your case is resolved, the cash will be returned to you and can be used to pay outstanding legal fees you may owe.
