I Went on Vacation, and Left on Probation
As all residents of Miami know, there are countless things to do in the Magic City besides taking in the beautiful beaches and soaking up the sun.
From South Beach to the Art Deco District, to Little Havana, Lincoln Road Mall, to Vizcaya Museum & Gardens and Key Biscayne (what locals call “the Key”), it’s no wonder why tourists are drawn to the area to take in the sights and enjoy the nightlife.
Whether someone’s visiting Miami for business or pleasure, sometimes a night on the town leads to an arrest for driving under the influence (DUI). What if you live in another state, such as Colorado and while visiting Miami you are arrested for your second DUI?
Your court date is coming up and you expect that you’re going to jail for 10 days. Your question is, “How will the probation work if I don’t reside in Florida?”
You know that you’ll have to see a probation officer once you’re released from jail, but you have no place to stay while in Miami, besides you have a job and a home in Colorado.
What You Can Expect
My first advice is – don’t throw in the towel! While you can have your probation transferred to Colorado, my suggestion is that you hire a Miami DUI lawyer who can access your case. Regardless of the facts of the case, you should consult a local attorney to discuss your possible defenses.
Instead of “assuming” that you’re going to jail, I suggest shifting your mindset. There are many defenses in DUI cases, and a good lawyer can explain which options may help.
I have seen everything in court, and some of the outcomes were miracles. You never know what’s going to happen unless you fight your DUI charges, even if you live out of state.
Whatever you do, don’t plead guilty to your DUI; doing so would cost you much more than you think over the long run. If you do have a prior DUI, a second DUI can have harsh consequences if you give up too easily, including jail and a lengthy license revocation!
