What Is A DUI Diversion Program?
Many first-time DUI offenders will have the opportunity to completely avoid a DUI conviction by participating in a diversion program. Depending on the program, some requirements include attending counseling or abuse classes, performing community service, submitting to random drug tests, paying fees or donations, and attending Mothers Against Drunk Driving victim impact classes.
My firm has been able to secure admission into the program even in cases of automobile accidents with police cars, excessive points on driving records, high breath test results, and drug possession charges. Such an accomplishment is by no means an easy feat, but I believe in the need to keep your record clean at all costs.
Wondering If You Are Eligible?
The Miami-Dade State Attorney’s Office has structured its eligibility process for the program to offer it in a specified group of cases.
In order to be eligible for Back on Track Miami, you must meet the following criteria:
- First arrest for DUI
- Must not have caused injury in a crash or damage to another vehicle
- No minor children were involved
- No open containers of alcohol found
- No prior felony convictions or withholds of adjudication
- Breath test result under 0.25%
If you have a prior criminal record, an exception can be made provided that the record does not exceed one non-violent felony or two prior misdemeanor convictions. You must not have completed more than one misdemeanor diversion program and must not have been driving on a suspended license when arrested for DUI.
