You Only Have 10 Days to Act!
If you were pulled over by an officer with an out-of-state driver's license and were charged with DUI, the officer will suspend your privilege to drive in Florida for at least 180 days by sending a report to the DHSMV. From that time forward, per Florida law, you will have 10 days to request a DHSMV hearing to prevent a license suspension in Florida. The Florida suspension may have an effect on your driving privileges in your home state.
If you fail to request a hearing within 10 days of an arrest, your license suspension in Florida will be sustained. If you are not from Florida, a report will be sent to your home state, which could suspend your license to drive in any state. You cannot simply ignore a criminal arrest and hope that an out-of-state arrest is somehow inapplicable to your driving privileges in another state. A criminal arrest is a serious matter no matter where or when you were arrested, and you must seek legal representation immediately.
