Zero Tolerance vs. Standard DUI: What's the Difference for Drivers Under 21?

Florida handles underage drinking and driving under two separate standards. Under the state’s zero-tolerance law (Fla. Stat. § 322.2616), it’s unlawful for a driver under 21 to operate a vehicle with a blood alcohol concentration (BAC) of 0.02% or higher. This low threshold is often reached after just one drink and triggers an automatic administrative license suspension, but doesn’t necessarily result in criminal charges.

However, young drivers aren’t immune to adult prosecution. If an underage driver’s BAC is 0.08% or higher or an officer determines their normal faculties are visibly impaired by drugs or alcohol, the state may prosecute the case as a standard DUI (Fla. Stat. § 316.193). A conviction carries much harsher penalties, including potential jail time, steep fines, and a criminal record.

The officer will confiscate the license and issue a citation that serves as a ten-day temporary driving permit. For a first DUI violation, this administrative suspension lasts for six months.

You only have ten days from the date of the arrest to request a formal review hearing with the Department of Highway Safety and Motor Vehicles (DHSMV). This hearing is your only opportunity to contest the suspension and keep the violation off your record. Missing this strict window means losing the ability to challenge the suspension.
