PENALTIES FOR LEWD & LASCIVIOUS BEHAVIORS
If you’re facing criminal charges for lewd and lascivious behaviors, your defense options are limited because it’s considered a strict liability crime.
As a strict liability crime, you can’t argue that:
- The minor consented to the conduct
- The minor requested the sexual activity
- The minor’s age was unknown at the time of the act
- The sexual conduct was unintentional
Per Florida’s Criminal Punishment Code, when an adult or a minor commits lewd and lascivious behaviors against a person under the age of 16, it is considered a Level 5 offense. Even if a defendant has no prior criminal history, the judge is required to sentence him or her to at least 30 months in prison and a minimum 2 years of sex offender probation.
The penalties for an adult offender include:
- Second degree felony
- Up to 15 years in prison
- 15 years of sex offender probation
- $10,000 fine
The penalties for a minor under the age of 18 include:
- Third degree felony
- Up to 5 years in prison
- 5 years of sex offender probation
- $5,000 fine
If you are convicted for lewd and lascivious conduct, you are required to comply with Florida’s sexual offender registration laws. This means that you must register as a sexual offender with local law enforcement so that your address and picture are available online for public reference. Likewise, a sex crimes conviction is a permanent mark on your criminal record that can never be expunged.
