Penalties For Lewd And Lascivious Charges

Per Florida’s Criminal Punishment Code, when an adult or a minor commits lewd and lascivious behaviors against a person under the age of 16, it is considered a Level 5 offense. Even if a defendant has no prior criminal history, the judge is required to sentence him or her to at least 30 months in prison and a minimum two years of sex offender probation.
